“On 17 March, the government published its draft Mental Capacity Act Code of Practice for public consultation. It incorporates the Liberty Protection Safeguards (LPS) which are the subject of this brief article. The consultation runs until 7 July.
The LPS will apply to all settings including domestic dwellings, unlike the Deprivation of Liberty Safeguards (DoLS) which only apply to hospitals and care homes.
Care home managers
The coordinating role of the care home manager under the legislation is no longer planned for implementation given widespread opposition within the sector but in time it would not be at all surprising if it was introduced should the LPS be seen to not be working as planned. In the meantime, the government has budgeted £67.14 to train each of the 18,512 care home managers across the country to be able to identify potential deprivations of liberty and refer them to the responsible body undertaking the pre-authorisation review. It is better than the original Impact Assessment which said the training cost was zero, but it is hardly a generous settlement.”
